These General Terms and Conditions of Sale (hereinafter "T&Cs") govern the purchase conditions for the various products offered on our website: www.pulseplay.eu, owned by Wayne Tech Corporation Ltd, a UK company with VAT number 16616348, located at 27 Gloucester Street WC1N 3AX, London, United Kingdom.
Users who make purchases on www.pulseplay.eu fully accept these T&Cs and are bound by them, as if they had been written at the time of purchase.
It is essential to read and accept the T&Cs before purchasing any product through www.pulseplay.eu.
WAYNE TECH CORPORATION LTD reserves the right to modify the T&Cs at any time and without notice. The T&Cs will always be accessible on the website, allowing users to view or print them at any time.
Prices and conditions of sale are for informational purposes only and are subject to change based on market fluctuations. However, placing an order implies acceptance of the price offered and the general terms and conditions of sale in effect at that time. Once the order is placed, the purchase will be considered finalized for all purposes, with all legal guarantees protecting the consumer. From that moment on, prices and conditions will be contractual and cannot be modified without the express consent of both parties. Spanish, French, English, German, Italian, or Portuguese will be the languages used to formalize the contract. The electronic document formalizing the contract will be archived and the user will have access to it in their customer area.

The payment methods available on PULSEPLAY.EU are credit card, PayPal, and bank transfer. Accepted credit cards are Visa, MasterCard, and American Express.
All credit card holders are subject to validation and authorization checks by the card issuer.

As part of the fight against Internet fraud, the Buyer's order data may be disclosed to third parties authorized by law or designated by PULSEPLAY.EU, solely to verify the Buyer's identity, the validity of the order, the payment method used, and the expected delivery time.
After this verification, WAYNE TECH CORPORATION LTD reserves the right to request a photocopy of the Buyer's ID and/or other information relating to their identity. The Buyer has the rights granted by personal data protection legislation, as set forth in the Privacy Policy.
4.- Reception by logistics agencies.
PULSEPLAY.EU has technological systems for scanning products and triple-checking outgoing shipments through its supplier. PULSEPLAY.EU is not responsible for damaged shipments received; therefore, the recipient is obligated NOT to accept any shipment showing signs of tampering by the logistics company, which may lead to theft or manipulation of the contents. PULSEPLAY.EU guarantees quality control of outgoing shipments, using packaging systems that ensure the traceability of each item in perfect condition for delivery.
5.- Mandatory Procedures in the Event of a Damaged Package
If a problem is encountered in the presence of the shipping company:
Refuse the delivery and report the incident clearly and in detail.
Indicate the reason for refusing the delivery to the shipping company's Customer Service.

Incident and complaint reports must be submitted as soon as possible and, in any case, within 2 business days of product delivery.
Mandatory Procedures in the Event of Missing or Damaged Products
It is essential to take photos of the outer box to document the condition in which you received your shipment, so we can process any complaints.
The Buyer must report the missing or damaged product to PULSEPLAY.EU Customer Service using the channels specified above. PULSEPLAY.EU Customer Service may request any information regarding the identity of the Buyer or the recipient of the Order and carry out any necessary checks.

8. Right of Withdrawal
In accordance with current legislation, you may exercise your right of withdrawal and cancel the contract without having to justify your decision and without penalty within 14 calendar days of receiving the product.
Article 68.1 of Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users, establishes the existence of the Right of Withdrawal, the consumer or user's right to withdraw from the contract without any consequences by notifying the other party within the time limit established for the exercise of this right, without having to justify your decision and without penalty of any kind.
The contracting company is obligated to provide the consumer or user with a clearly identified Withdrawal Document or return management form (Art. 69.1 RDLg 1/2007).
The consumer or user has 15 days to exercise this right, which will begin from the date the product is received by the buyer or the date it is collected by an agency outside our facilities (Art. 71 RDLg 1/2007).
The costs incurred for the return will be borne by the buyer (Art. 101.1 RDLg 1/2007). By virtue of the above provisions, the applicant accepts and exercises the Right of Withdrawal provided for by the applicable legislation.
What are the reasons for a return?
If you wish to return your order within 15 days of receiving it.
If the product is under warranty.
If the product is defective.
If the product received was damaged during transport.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to contracts that include:
Fully performed services, provided that the consumer has expressly consented to the commencement of the service and acknowledges that they lose their right of withdrawal once the service has been completed.
Goods subject to market fluctuations beyond the seller's control that may occur during the withdrawal period.
Personalized products or products made to the consumer's specifications.
Goods that deteriorate or expire rapidly.
Sealed products (such as sex toys, sexual health cosmetics, and lingerie) that, for health or hygiene reasons, are not suitable for return if the seal has been removed after delivery.
Goods inseparably mixed with other products after delivery.
Sealed applications, videos, or software that have been opened after delivery.
Daily press, periodical publications, or magazines, with the exception of subscription contracts.
Digital content not supplied on a physical medium, when the performance has begun with the consumer's express consent and the consumer acknowledges that they lose their right of withdrawal.
Refund Procedure
Once we receive the product(s), the refund will be made within 1-5 business days using the original payment method:
Credit/debit card, PayPal, or bank transfer: The refund will be made to your wallet balance.
Financing: A full or partial cancellation of the financed amount will be processed, as applicable.
Please note that you will only be liable for any diminished value of the goods if they have been handled improperly, i.e., beyond what is necessary to determine their nature, characteristics, or functioning.
9.- Returns Policy
To process a refund, you must return the entire package, including the original product and any accompanying gifts or promotional items. For products that include application download codes, the code must not have been used to receive a full refund.
Returns will only be accepted if the item remains unopened and in perfect condition, within 14 calendar days of receipt.
Return Restrictions: Returns of products in blister packs, heat-sealed packages, or with broken factory security seals will not be accepted.
These conditions do not affect the right to a warranty or exchange for defective products. PULSEPLAY.EU reserves the right to refuse a return if an anomaly is detected in the returned product.
10.- Warranties
The warranty does not cover defects caused by misuse or handling of the product beyond what is necessary to establish its nature, characteristics, or functioning. In such cases, the consumer will bear the costs of repair. Therefore, the warranty excludes:
Defects and deterioration caused by external factors, accidents (especially electrical ones), natural wear and tear, or improper use according to PULSEPLAY.EU's instructions.
Products that have been modified or repaired by the customer or anyone not authorized by PULSEPLAY.EU, as well as those with a specific support contract.
11.- Order Cancellations
To cancel an order, log in to your dashboard in the "My Orders" area. If the cancellation option is not available, it means the order has already been shipped and is no longer in our facilities. In this case, please send an email to info@pulseplay.eu.
Please note that canceling an order that is in the "Production Logistics" phase may result in a penalty of up to 15% of the total amount.
Cancellations that result in a refund via bank transfer will have a maximum processing time of 30 days due to administrative procedures, although we aim to complete the refund within approximately 7 days.
15. Dispute Resolution
In accordance with Article 14.1 of Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, the European Commission provides a platform for online dispute resolution, accessible via the following link: http://ec.europa.eu/consumers/odr/.
This platform allows consumers and businesses to resolve disputes out of court, facilitating an efficient and transparent process.
